Probably majority of us are wondering how to fight a traffic ticket, why? Well, simply to avoid paying for something you either did or didn’t do.

So, you have been driving way above the speed limit, ran the red light or broke any other traffic law, and you have been handed over a traffic ticket. But just because you got a ticket, you may not necessarily need to pay for it as there are many excellent strategies for fighting a traffic ticket and avoid any fines whatsoever, saving money in the process. Following are top 4 strategies that might just work in your case.

4 Strategies to Fight a Traffic Ticket in Court

1. You can challenge the police officer’s subjective conclusions and observation

In many states, you can challenge the officer’s view of what really happened. This is particularly useful in cases where a cop have to make a judgment based on the situation and decide whether you broke the law or not.

For example, if you are given a traffic ticket for taking an unsafe left, you can say that your actions were “responsible and safe” due to the traffic conditions. Moreover, you can fight a traffic ticket by arguing that a police officer could not clearly see what really happened as he or she was too busy doing other things or was driving in a heavy traffic.

Beside challenging the officer’s subjective conclusion, other strategies for fighting a traffic ticket are to argue that cop’s observation about you breaking the law is not true and that in fact, you are right. In court it is usually the police officer who wins, but if you can convince the judge that you did not broke the law, good for you.

2. Prove that your actions were “legally justified”

Sometimes, when you are charged by braking a law, you can justify your actions by stating that you had to undergo such action simply to obey another law.

For example, if you are given a traffic ticket for driving too slow in a left lane, you can fight traffic ticket by stating that you had to slow down to make a safe left turn as the law dictates. Defending yourself by legally justifying your actions with another law is usually very successful in the court.

3. Prove that you had to undergo such actions to “avoid harm”

Another one of the four strategies for fighting a traffic ticket is to justify your actions were necessary in order to avoid possible harm. For example, if you are given a speeding ticket, you can say that you had to speed up to avoid an out-of-control truck, or to avoid the collision with the traffic entering the highway because you were “boxed in” from the left by other cars.

Another great defense is stating that you had to swerve across the double line in order to avoid an animal, other vehicle, pedestrian or any other object that came in the way.

But make sure though that you do not come up with silly excuses such as that your mind wandered away and you didn’t see a red light or that you were arguing on the phone and didn’t realize you were speeding. That will only cost you another traffic ticket, so make sure that you are presenting a necessary defense based on the road conditions.

4. You can also fight a traffic ticket by proving that your conduct was a “mistake of fact”

One of the good strategies for fighting a traffic ticket is to prove that you made an honest and reasonable mistake and a judge might just allow for some leeway. For example, you can prove that you didn’t stop at the pedestrian crosswalk markers because they could not be clearly seen due to a storm or because they were old and faded.

Regardless whether you actually broke the law or not, the above four strategies for fighting a traffic ticket can come very handy and might just save you from paying a high fee.
